Как выглядит свидетельство о государственной регистрации в качестве индивидуального предпринимателя? Этот вопрос волнует многих, поскольку с 2017 года произошли существенные изменения в официальных бланках при открытии ИП. С указанного периода, а именно с 01.01.17 г., налоговые органы более не выдают свидетельство о госрегистрации ИП, заменив этот привычный документ на лист записи из ЕГРИП.
Как изменилось свидетельство о государственной регистрации индивидуального предпринимателя
Ранее свидетельство о регистрации физического лица в качестве индивидуального предпринимателя выдавалось всем гражданам при открытии ИП. Документ имел форму Р61001 и действовал на основании Приказа Правительства № 439 от 19.06.02 г. (Приложение 22). С 2013 года форма изменилась на Р61003 по Приказу № ММВ-7-6/843@ от 13.11.12 г. (Приложение 3). Однако 12.09.16 г. ФНС утвердила Приказ № ММВ-7-14/481@, которым отменила и предыдущий приказ, введя в действие лист записи в ЕГРИП по форме Р60009.
Таким образом, свидетельство о государственной регистрации физического лица в качестве ИП более не оформляется, но все прежние, уже выданные, документы сохраняют свою законную силу, узаконивая правовой статус предпринимателя. Бланком, подтверждающим факт регистрации гражданина в реестре, является лист записи, который содержит все основные сведения о физлице и рабочих видах деятельности. Как изменилось свидетельство о постановке на учет индивидуального предпринимателя
Нововведения коснулись и такой формы, как свидетельство о постановке на учет ИП. Бланк является еще одним важным регистрационным документом предпринимателя, поскольку содержит данные об ИНН физлица и подлежит переоформлению при смене адреса проживания. Это свидетельство введено в действие актуальным Приказом ФНС № ЯК-7-6/488@ от 11.08.11 г. и пока не отменено. Но печатают документ не на специальном бланке с голограммой, а на обычной бумаге формата А4.
Почему же изменился прежний порядок налогового документооборота, а свидетельство о регистрации индивидуального предпринимателя более не выдается? Причина указана в Приказе № ММВ-7-14/481@, где сказано, что новый регламент утвержден в целях повышения эффективности процедуры регистрации хозяйствующих субъектов. Столь размытая формулировка, по-видимому, означает необходимость в экономии средств в связи с упрощением документооборота, а также ускорение регистрационных действий при открытии или ликвидации бизнеса.
Как бы то ни было, на практике для налогоплательщиков ничего не меняется. Как раньше бизнесмен вел законную деятельность, а подтверждением этого выступало свидетельство о госрегистрации ИП, так и теперь работа осуществляется согласно официальным бумагам. Только вместо ф. Р61003 выдается лист записи ф. Р60009. Если же гражданин открыл собственное дело до 01.01.17 г., в этом случае создан индивидуальный предприниматель, действующий на основании свидетельства. Так как уже выданная документация продолжает действовать, обновлению подлежат только бланки с 2017 г.
Как восстановить свидетельство ИП
А что делать тем физлицам, кто утратил свидетельство индивидуального предпринимателя? Можно ли получить дубликат этого документа? К кому обращаться и какие сведения предоставить? Как таковое восстановление свидетельства ИП, то есть получение повторного бланка, невозможно, поскольку нормативно-правовой акт, утвердивший форму, уже отменен. Но не спешите расстраиваться, в оформлении свидетельства нет никакой необходимости. Если документ утрачен, нужно запросить выписку из ЕГРИП.
Запрос делается в письменной форме, по обращению в ИФНС налогоплательщика или его представителя. Или же можно получить выписку на сайте налоговой инспекции, в соответствующем разделе. Документ, заверенный электронной подписью налоговиков, будет иметь полную юридическую силу. Таким образом, свидетельство предпринимателя более не нужно требовать и у контрагентов для проверки благонадежности поставщиков товаров или услуг. В качестве подтверждающей законную деятельность формы также будет выступать лист записи из единого реестра.
Свидетельство о регистрации ИП – как выглядит
Как уже говорилось ранее, старое свидетельство о государственной регистрации ИП, образец формы Р61003 выложен чуть ниже, по-прежнему имеет юридическое действие, если уже было выдано при открытии предпринимательства. Какая информация отражается в этом документе? Приложение 3 Приказа № ММВ-7-6/843@ от 13.11.12 г. содержит подробный ответ. Прежде всего, подобный документ распечатан не простой бумаге, а специальной, с несколькими степенями защиты – голограмма, рисунки и знаки, герб РФ, индивидуальные номер и серия и т.д. Кроме того, в бланке указывается основная регистрационная информация о предпринимателе.
Свидетельство индивидуального предпринимателя – обязательные реквизиты:

Точные и полные ФИО гражданина, отчество приводится только при его наличии.

Присвоенные ОГРНИП и дата записи о получении статуса предпринимателя.

Наименование территориального подразделения налоговых органов, проводящих регистрацию ИП.

Дата выдачи формы и печать ИФНС.

Личная подпись ответственного лица – проставляется с указанием должности и ФИО инспектора.
Обратите внимание! Серия и № свидетельства всегда состоят из 2 цифр (для серии) и 9 (для номера). При этом такие данные являются индивидуальными, присваиваются каждому предпринимателю отдельно и не могут повторяться ни при каких обстоятельствах.
В каких случаях требуется свидетельство о регистрации ИП
Этот бланк наравне с заменившим его листом записи является основным документом, подтверждающим факт регистрации гражданина в статусе ИП. Согласно нормам гражданского законодательства каждый человек вправе заниматься предпринимательством, без обязательного открытия юрлица, но при условии государственной регистрации в контрольных органах. Случаи нелегальной деятельности караются штрафными санкциями по уголовному и административному законодательству. Поэтому перед тем, как приступать к развитию собственного бизнеса, требуется официально зарегистрироваться в госорганах.
Кроме того, только с предъявлением свидетельства предприниматель сможет оформить лицензии и разрешения при ведении определенных видов деятельности, открыть расчетный счет и получить кредиты в банках, заказать изготовление печати, сдать отчетность, заключить договора с надежными партнерами и пр. Коротко говоря, выданный налоговой инспекцией документ о госрегистрации ИП – это официальное подтверждение законности вашего бизнеса.

Свидетельство ИП – образец
Рассмотрим, как выглядит свидетельство ИП – фото приведены для всех возможных форм. Начнем с бланка ф. Р61001 по Приказу №439 от 19.06.02 г. Как видно на фотографии этот документ содержит основной регистрационный № созданного предпринимателя, дату внесения соответствующей записи в ЕГРИП, наименование контрольного госоргана, подпись, ФИО и должность ответственного инспектора налоговой службы. Форма распечатана на специальном бланке, защищена всеми возможными способами и отмечена серией и номером. Именно такая форма выдавалась гражданам при создании ИП ранее.

На смену ф. Р61001 пришла форма Р61003 по Приказу № ММВ-7-6/843@ от 13.11.12 г. Этот документ в принципе мало чем отличается от своего предшественника, что можно видеть на рисунке № 2. Также здесь указан регистрационный номер (ОГРНИП) физлица в статусе предпринимателя, дата внесения записей в реестр, наименование территориального подразделения ИФНС, должность и ФИО ответственного сотрудника, а также его личная подпись. Добавлена строка для даты выдачи ф. Р61003. Документ распечатан на специальной бумаге с голограммой и прочими уровнями защиты.

Наконец, рассмотрим, как выглядит лист записи ф. Р60009, актуальный при регистрации предпринимателей с 01.01.17 г. Этот документ составлен на обычной бумаге, без каких-либо специальных степеней защиты, но также содержит все необходимые реквизиты, включая запись о приобретении гражданином статуса ИП. В первую очередь это подтверждается основным регистрационным номером (ОГРНИП), датой внесения такой записи, наименованием территориальной налоговой службы. Отдельно приводятся личные данные о физлице.

Для чего нужно свидетельство о закрытии ИП
Если предприниматель прекращает свою деятельность, как сдать свидетельство ИП? И нужно ли предоставлять этот документ в регистрирующий орган? Чтобы закрыть собственный бизнес, физлицу необходимо выполнить ряд обязательных действий, одно из которых включает подачу пакета документации в налоговую инспекцию. В такой перечень входит предоставление копии регистрационных свидетельств о факте открытия ИП. После того, как соблюден регламент юридической процедуры, гражданин получает «на руки» документы о закрытии ИП.
С 2017 года, как и при создании предпринимательства, прекращение деятельности ИП подтверждается оформлением листа записи ф. Р60009. Только в отличие от регистрации открытия бизнеса при его закрытии делается иная запись – об исключении физлица из Единого Реестра (ЕГРНИП). С момента отражения такой записи предприниматель официально считается прекратившим свою деятельность, но все неисполненные обязательства переходят к физлицу. Поскольку согласно стат. 24 ГК гражданин несет полную ответственность по долгам, возникшим в результате его коммерческой деятельности.
Вывод – мы разобрались, что права ИП, действующего на основании свидетельства, и ИП, действующего на основании листа записи, одинаковы, потому что два этих документа – равноценны. На приведенных фотографиях видно, в чем состоят отличия и сходства между унифицированными формами, актуальными ранее и сейчас. Основная разница заключается в прекращении использования специальных бланков с голограммами, но юридическая сила документов от этого не уменьшилась.

К этим документам приложите квитанцию об оплате пошлины и отправьте письмом с описью вложения в регистрирующий орган (в Москве это МИФНС № 46 по г. Москве).
Если вы прописаны в Москве, можете воспользоваться курьерскими службами Pony Express или DHL Express — у них со столичными налоговиками договор. В других городах опция не работает, зато работает «Почта России».
Плюс: Вы имеете право не приходить в налоговую вообще и получить готовые документы почтой по адресу прописки.
Если живете в другом городе — попросите кого-нибудь подать документы за вас
Оформите у нотариуса доверенность на этого доброго человека — друга, родственника или сотрудника юридической компании. Присутствие доверенного лица необязательно — достаточно предоставить нотариусу его паспортные данные.
Далеко не уходите: заверьте у нотариуса копию паспорта и подпись на заявлении. Вместе с квитанцией об оплате пошлины передайте документы своему представителю.
Он, вооруженный доверенностью, отвезет всё в налоговую или, если так удобнее, в Многофункциональный центр (МФЦ).
Плюс: Вы имеете право не приходить в налоговую вообще и получить готовые документы так же, как подавали заявление, — через представителя.
